We reserve the right to update the Policy at our discretion, and will make the current version of the Policy available to you on our website holyyoga.net and available through links in our mobile device applications. You can determine if the Policy has been revised since your last visit by referring to the “Last Modified” date at the top of this document. While we will make reasonable efforts to notify you of changes to this Policy, we may not notify you of such changes by e-mail or other direct personal contact, and you are responsible for reviewing the Policy when you utilize the Platform.
By utilizing the Platform, you agree to the terms of this Policy. If you do not agree with the terms of this Policy, you may not use the Platform. As a general principle, information you provide to us will be collected, stored, used, and shared as outlined in this Policy.
1. INFORMATION WE COLLECT
We collect two basic types of information from you in connection with your use of the Platform: Personal Information and Non-Personal Information. “Personal Information” is any information that can individually identify you and includes, for example and without limitation, your name, email address, username, likeness or photograph, telephone number, postal address, or billing information. “Non-Personal Information” includes information that does not personally identify you, and may include tracking and usage information, demographics, de-identified transaction information, information regarding your use of the Platform and the internet, etc.
Personal Information. There are a number of circumstances in which you may voluntarily supply us with your Personal Information, such as these common ones:
- Registering for an account on the Platform
- Sign up to receive information or related services from us
- Requests for customer service or other assistance
- Participation in surveys, special events, and promotions
- Participation on social media accounts involving Holy Yoga
Non-Personal Information. When you use the Platform, our servers may keep an activity log that does not identify you individually. These logs may include information such as device information about your computer, mobile device, or other device that you use to access the Platform, which may include your IP address, browser, etc., and additional traffic data, such as time and date of access, access times, and referring website addresses. We use this information to assist us in running the Platform and ensuring proper operation.
Children’s Online Privacy. Holy Yoga is committed to complying with the Children’s Online Privacy Protection Act (COPPA). Holy Yoga requires you to be at least 18 years old to use the Platform. We do not knowingly solicit, collect, utilize, or disclose Personal Information from minors. If we learn that a minor has provided Personal Information to us, we will take commercially reasonable steps to delete that information.
2. HOW WE USE INFORMATION
We use the information we collect from you and about you to help us personalize and continually improve your experience with the Platform. We may use the Personal Information and Non-Personal Information we collect from and about you in at least the following ways:
- Provide you with the products and services you request from us
- Facilitate a transaction involving you, including as an instructor or with an instructor
- Communicate with you about your account or transactions with us and send you information about features on the Platform
- Communicate with you about changes to our policies
- Personalize content and experiences on the Platform
- Send you newsletters, offers, and promotions, third party products and services, or special events by email or other media
- Optimize or improve our products, services, and operations
3. OUR DISCLOSURE OF INFORMATION
We will only share Personal Information as provided for in this Policy, and within our company and corporate affiliates.
As part of using and/or accessing the Platform, we may share your Personal Information and/or Non-Personal Information with third party companies and individuals to facilitate or provide services in connection with the Platform, to provide customer support, provide geo-location information to instructors, to perform website and mobile application-related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of Platform features) or to assist us in analyzing how the Platform is used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are contractually bound not to disclose or use it for any other purpose.
Premium Services. When you order any paid or premium services from us, or process yoga class payment or scheduling information through the Platform, your Personal Information, including payment details, may be provided to a third party in connection with processing and completing the transaction.
Third Party Direct Marketing. From time to time, Holy Yoga, an instructor, or others may use your Personal Information for direct marketing of products or services beyond the Platform. To abide by California’s “Shine the Light” law, California Civil Code § 1798.83, which requires that you agree to the disclosure (opt-in) or if you have exercised an option to opt-out of such information-sharing (opt-out), we do not share your Personal Information with third parties for the third parties’ direct marketing purposes unless you provide us with permission at the time of registration with the Platform, or later by changing the opt-out setting in your user account profile. If you are a California resident and have an established relationship with us, you can request a notice disclosing the categories of Personal Information we have shared with third parties, for the third parties’ direct marketing purposes, during the preceding calendar year. Third-Party Integration. Via the Platform, you may be able to interact with third-party accounts, for example accounts on Facebook, Twitter, and the like. For example, you may utilize the Platform to publicize on Facebook past or future yoga sessions. We may collect, store, use, and/or disclose the Personal Information that you make available to us on any social media page or account linked to your use of the Platform, including your user ID and/or user name, and any information you have made public in connection with that social media service. Please note, however, that we will comply with the privacy policies of the corresponding social media platform and we will only collect, store, use, and disclose such Personal Information that we are permitted to collect by these social media platforms. By linking a social media account to your account on the Platform, you represent that you are authorized to provide any Personal Information accessible thereby to Holy Yoga.
Compliance with Laws. Holy Yoga will abide by the United States of America data privacy laws. Accordingly, Holy Yoga may disclose your Personal Information to the extent that this is legally required, or necessary for the establishment, exercise or defense of legal claims and legal process, or in the event of an emergency as requested by law enforcement or rescue / medical services.
Merger, Sale, Or Bankruptcy. If we sell all or part of our business, or make a sale or transfer of our assets, or are otherwise involved in a merger or transfer of all or a material part of our operations, or are involved in a bankruptcy, Holy Yoga may transfer your Personal Information and Non-Personal Information to the party or parties involved as part of that transaction.
Links to or from Other Sites. Please note that the Platform may link to other websites and online services operated by third parties. These websites and applications operate independently from us, and we do not control their privacy policies, which may be different from ours. We encourage you to review the privacy policies of any third party websites or applications. Holy Yoga is not responsible for the content or policies of any third party services.
“Do Not Track” Practices. At this time, we do not honor or have the capability to process do-not-track signals from browsers or other consumer choice mechanisms regarding the collection of behavioral tracking data. While we collect Personal Information from you as described above, we do not collect Personal Information from you to monitor your online activities across third party websites or online services and over time (also known as behavioral advertising or interest-based advertising). We do not use or allow third parties to collect Personal Information from you via the Platform in order to monitor your online activities across third party websites or online services and over time.
In connection with your use of the Platform, your Personal Information and Non-Personal Information are collected and stored in secured databases and servers hosted by Infusionsoft. We use standard, industry-wide, commercially reasonable security practices such as encryption, firewalls and SSL (Secure Sockets Layer) for protecting your information. Due to the nature of security practices (there is no 100% secured platform available in the industry), we cannot guarantee the security of our databases, nor can we guarantee that information you supply in connection with use of the Platform will not be intercepted while being transmitted to us over the Internet or wireless communication. Therefore, any information you transmit to the Company is at your own risk. You are responsible for your account data and should safeguard your account information including your password. We do not promise, and you should not expect, that your Personal Information or private communications will always remain private.
5. NOTICE TO NON-US USERS
As the Internet is a global environment, collecting and processing Personal Information may involve the transmission of this data internationally, including into and/or outside of the United States. Therefore, by communicating electronically with us you acknowledge and agree to your Personal Information being processed in this way.
Specifically, if you are located outside of the United States, please be aware that by using the Platform your Personal Information may be transferred to the United States, the privacy laws of which may be deemed by your country to have inadequate data protection. If you are located outside of the United States and voluntarily submit Personal Information to us, you thereby consent to the general use of such information as provided in this Policy and to the transfer of that information to, and/or storage of that information in, the United States. Nevertheless, currently our Platform is intended for users only within the United States.
